SUMMARY:Foundations in Corporate Investigations - Module 1
DESCRIPTION:The ACi 5-module course has been developed for aspiring investigators and individuals who have investigations as part of their remit but have not received any investigative training\, and for those who are considering a career change to determine if being an investigator is for them. \nThis course is run online via live webinars and is based on a whistleblowing report and case study. There are five modules that take delegates through the theory and practice of running a successful investigation. \n \nModule 1\nAssessment of the case study\nDelegates examine a case study\, some supporting documents and some theory on Investigative Assessment. We review the case study and discuss the assessment phase. The webinar provides additional Open Source Intelligence research information to review and discuss. In addition\, there is a role play interview with the Source of the concerns. \nModule 2\nPlanning\nIn this module delegates will explore the Planning Stage of conducting an internal investigation. We will explore the activities undertaken during a good practice planning process and prepare an investigation plan. \nModule 3\nCollection and evaluation of evidence\nA role play interview is conducted with the witness and the subject\, showcasing some of the techniques essential for a good interview (introduction\, rapport building\, open-ended questions\, closed questions\, producing documents\, challenge questions etc.)\, including poor interviewing techniques to show what can happen with poor interview practices.  At the end of the session\, we will summarise the investigation. \nModule 4\nReport Writing\nWe discuss report writing\, finalise the key findings together and the structure of the report. A final example of the investigation report is reviewed. Section 748 of the Dodd-Frank Wall Street Reform and Consumer Protection Act established a whistleblower program under which the CFTC will pay awards\, based on collected monetary sanctions\, to eligible whistleblowers who voluntarily provide original information about violations of the Commodity Exchange Act that lead either to a “covered judicial or administrative action” or a “related action.” Mr. Ehrman formerly served as an Assistant Director in the Office of Market Intelligence at the Securities and Exchange Commission. In that role\, he oversaw the processing\, review and assignment of all tips\, complaints and referrals received by the SEC. Mr. Ehrman also formerly served as the Co-National Coordinator for the Microcap Fraud Working Group\, a cross-divisional specialized group charged with creating novel ways to detect\, disrupt and prosecute fraud relating to securities quoted on the OTC Market. Prior to joining OMI\, Mr. Ehrman worked in a variety of other roles within the SEC’s Division of Enforcement\, including Branch Chief\, Senior Counsel\, and Staff Attorney. Mr. Ehrman is a graduate of Miami University and the University of Kentucky College of Law. \nMary Inman \nMary Inman is a partner in Constantine Cannon’s London and San Francisco offices. After 20+ years representing whistleblowers in the U.S.\, she moved to London in July 2017 to launch the firm’s international whistleblower practice and after 3.5 years in London\, she now splits her time between the London and San Francisco offices. She specializes in representing whistleblowers from the U.S.\, U.K.\, Europe and worldwide under the American whistleblower reward programs\, including the federal and various state False Claims Acts and the SEC\, CFTC\, IRS\, DOT and new Treasury Department AML whistleblower programs. Ms. Inman’s efforts to export the American whistleblower programs to the United Kingdom\, including her efforts on behalf of a successful British whistleblower\, were featured in a recent New York Times article “Law Firm Sees Britain as Hunting Ground for U.S. Whistleblower Cases.”  Ms. Inman’s successful representation of three whistleblowers exposing fraud in the Medicare Advantage program was featured in the February 4\, 2019 issue of the New Yorker magazine in an article entitled “The Personal Toll of Whistle-Blowing.” Ms. Inman was interviewed for a CNBC segment entitled “How corporate whistleblowers make millions”\, which aired in November 2019\, discussing the SEC’s successful whistleblower program. Ms. Inman represents renowned whistleblower Tyler Shultz who exposed the now infamous Silicon Valley blood testing start-up Theranos\, and regularly speaks on lessons to be learned from this scandal. Most recently\, Ms. Inman led 11 teams across the globe in responding to a challenge issued under the Financial Times’ Global Legal Hackathon to empower whistleblowers to help alleviate problems created by the COVID pandemic.  \n  \nAnnabel Kerley \nAnnabel Kerley\, ACi Advisor\nAnnabel Kerley is a Chartered Accountant and holds a Graduate Diploma in Law. DESCRIPTION:  \nIn this session\, ACi’s CEO Steve Young interviews Antoine Deltour – the main whistleblower in LuxLeaks case. \n  \nAntoine worked as an auditor for PwC Luxembourg from 2008 to 2010. When he resigned\, he copied hundreds of tax rulings that have lead\, amongst other documents\, to the so-called “LuxLeaks scandal”. The disclosure of large-scale tax avoidance practices fostered several initiatives for better tax justice. But Antoine Deltour faced criminal charges in Luxembourg. After a first conviction to a 12-months suspended sentence in 2016 followed by several appeals\, he was finally recognized a whistleblower and was acquitted for all the charges related to the Luxleaks. He is now working for the French statistics administration and is involved in several organizations protecting whistleblowers. \n  \n \n

In 1995 Rainer was seconded to the Interpol General Secretariat in Lyon\, France\, as the Head of the Economic Crime Branch. In 2002 Rainer left the Police and joined Interpol as the Head of the Anti-Corruption Directorate. In 2008 Rainer joined the German engineering company Siemens AG in Munich as the Global Head of Compliance Investigations\, managing Offices in Germany\, the United States\, China\, Mexico\, Russia and the United Arab Emirates. In 2014 Rainer returned to South Africa as the Regional Compliance Officer for Africa. Rainer has vast experience in conducting and managing financial crime investigations and has dedicated a large part of his career to combatting Corruption in the public and private sectors. Rainer is also a proud founder member of the International Anti-Corruption Academy situated in Vienna\, Austria. \n  \nDave Loxton\, Partner\, Schindlers  \nDave Loxton began his career as a state prosecutor\, prosecuting the complete range of “ street crimes” such as rape\, murder\, robbery\, drug-related crimes as well as fraud\, corruption\, theft and forgery. He has been in-house counsel at a major listed entity\, and in private practice has been a partner in some of South Africa’s premier law firms. He started the white-collar crime practice areas in a few of these firms. He has acted in many highly sensitive matters involving fraud and corruption\, often crossing multiple jurisdictions. He opened the first UK drugs liaison post in Paris in 1992 and returned to France in 2002 to perform the fiscal crime role. Between 2006 and 2009 he led the HMRC Fiscal Crime Liaison Network\, driving through a significant expansion programme in China\, Malaysia\, Eastern Europe and the UAE. From 2012 to 2018 he served as Counsellor for Fiscal Crime Liaison at the British Embassy\, Washington DC. He now leads a series of cross-cutting projects for HMRC Organised Crime Operations. \nHe has also undertaken several external secondments\, to the police regional crime squads\, to the National Criminal Intelligence Service\, and to the Foreign and Commonwealth Office – for the strategic drugs survey of Central Asia 2001/02.  He became active in the OECD Countering Illicit Trade Task Force in 2014\, and has held the position of Chair since 2018. \nJohn Flint\, Global Head of Anti-Illicit Trade\, British American Tobacco. \n \nJohn started his career as a British Diplomat in 1996. Following stints in London\, Eastern Europe and the Eastern Caribbean working on a variety of bilateral and multilateral issues\, John joined the National Criminal Intelligence Service (NCIS) in 2002. Following a variety of roles in NCIS and subsequently\, the UK’s Serious Organised Crime Agency (SOCA)\, John was posted to the Balkans as the Regional Head of Investigations. With teams based in the British Embassies across the Balkans\, John was responsible for managing the UK’s relationship with national law enforcement and intelligence agencies and led investigations in a multitude of threat areas\, including drug trafficking\, people smuggling and fraud. John joined BAT in 2013 following 17+ years as a public servant. Based initially in Budapest and then Prague\, John managed security and anti-illicit trade for a cluster of 12 countries in Central and Eastern Europe before moving to BAT HQ to take up the global position as Head of Anti-Illicit Trade (AIT). The AIT team at BAT consists of a number of engagement managers which assist BAT markets in their efforts to combat the illicit tobacco trade\, as well as a Forensics and Compliance Team which provide product authentication and illicit trade analysis\, as well as compliance activities to ensure the security of BAT’s own supply chain. \nDavid M. DESCRIPTION:Cyber Crime Investigations are more and more prevalent but many corporate investigators do not have current knowledge or tools to manage these complex investigations successfully.
