He has also managed investigations in the not-for-profit and charity sector\, looking at financial crime and counter-terrorism risks. Ash is a Certified Fraud Examiner\, Certified Financial Crime Specialist\, and Certified Cryptocurrency Investigator. DESCRIPTION:ACi is delighted to support the United Nations International Anti Corruption Day this year. \nYour right\, your role: say no to corruption\nVotre droit\, votre défi : dites non à la corruption\nTu derecho\, tu desafío: dile no a la corrupción\nاحفظ حقك، العب دورك: قل لا للفساد\n你的权利，你的作用：对腐败说不\nтвое право\, твоя роль: скажи коррупции нет \nOn 31 October 2003\, the United Nations General Assembly adopted the United Nations Convention against Corruption (UNCAC) and the United Nations Office on Drugs and Crime (UNODC) based in Vienna\, Austria\, as the secretariat to the Conference of the States Parties to the Convention. The Convention was opened for signature at a High-Level Signing Conference held in Mexico from 9 to 11 December 2003. As such\, the General Assembly designated 9 December as International Anti-Corruption Day (IACD)\, to raise awareness of corruption and of the role of the Convention in combating and preventing it. \nThe UNCAC places a premium on the prevention of corruption as a fundamental aspect of criminal justice. It provides for a comprehensive range of preventive anti-corruption measures in a dedicated Chapter (Chapter II) which precedes the Chapter on criminalization and law enforcement. Several provisions of the Convention address the private sector. Among them\, Article 12\, under Chapter II\, calls upon States parties to ensure “…that private enterprises\, taking into account their structure and size\, have sufficient internal auditing controls to assist in preventing and detecting acts of corruption…”. As such\, the prevention of corruption is an obligation for the corporate world too. \nThe theme of International Anti-Corruption Day 2021 is: “Your right\, your role: say no to corruption”. The key message is that a corruption-free word is everybody’s right\, and that anti-corruption efforts are everybody’s responsibility – governments\, companies\, professions\, society and individuals alike. The second key message is that policies\, laws and mechanisms must be in place\, in public and private sectors\, for individuals to be able to speak up and say no to this crime without fear of unjustified treatment. An environment where individuals feel free to report wrongdoings\, in good faith and on reasonable grounds\, contributes to a culture of lawfulness and integrity. It provides a strong deterrent to corrupt practices by those who count on low detection risks if not impunity. \nGiovanni Gallo will explain the ongoing role of the UNODC as the “managers” of the UNCAC\, their efforts to raise awareness and promote the speak-up culture around reporting corruption and how the Convention addresses the role of the private sector. There will also be a description of a significant integrity initiative developed by the World Bank to establish longer term funding for anti-corruption initiatives. Duncan Smith from the European Investment Bank will then describe anti-corruption efforts from a multi-lateral bank perspective – investigating and sanctioning governments and corporations who engage in corrupt acts in MDB funded projects\, and how they can assist in building integrity cultures in the private sector. He oversees the global delivery of technical assistance for governments to better implement the UN Convention against Corruption. Over the past 20 years\, he held several positions at UNODC\, both at headquarters and in the field. \nFrom 2011 to 2019\, Mr. Gallo served in the Office of the Director-General of the United Nations Office of Vienna (UNOV) and Executive Director of UNODC. He was Deputy Chief of the of the Office from 2011 to 2015\, when he received the additional role of Senior Legal Adviser to the Director-General and Executive Director. \nFrom 2006 to 2010\, Mr Gallo supported Member Sates’ efforts to tackle transnational organized crime and corruption by providing normative and operational assistance in line with the UN Convention against Transnational Organized Crime and its Protocols and the UN Convention against Corruption. From 2001 to 2003\, he worked for the UNODC Office in Myanmar. \nMr. Gallo is a lawyer by training and holds an advanced law degree from the University of Bologna\, Italy. \nDuncan Smith\, Deputy Head of Fraud Investigations\, European Investment Bank \nDuncan Smith is Deputy Head of Fraud Investigations at the European Investment Bank. As a barrister\, he prosecuted fraud & corruption in the UK. After working for the World Bank’s Investigation Unit (as Team Leader and then policy adviser)\, he moved to the European Investment Bank to address outreach\, training\, prevention and deterrence issues. Within 2 months\, Sylvain had uncovered a $20M fraud that spanned 12 years and led to the perpetrator – a finance executive with 30 years of experience in the company – admitting to the crime\, and ultimately being sentenced to 15 years in prison. Although he was promoted in his organization\, Sylvain couldn’t stop thinking about how his experience as a whistleblower could have been better. SUMMARY:Foundations in Corporate Investigations - Module 1
DESCRIPTION:The ACi 5-module course has been developed for aspiring investigators and individuals who have investigations as part of their remit but have not received any investigative training\, and for those who are considering a career change to determine if being an investigator is for them. \nThis course is run online via live webinars and is based on a whistleblowing report and case study. There are five modules that take delegates through the theory and practice of running a successful investigation. \n \nModule 1\nAssessment of the case study\nDelegates examine a case study\, some supporting documents and some theory on Investigative Assessment. We review the case study and discuss the assessment phase. The webinar provides additional Open Source Intelligence research information to review and discuss. In addition\, there is a role play interview with the Source of the concerns. \nModule 2\nPlanning\nIn this module delegates will explore the Planning Stage of conducting an internal investigation. We will explore the activities undertaken during a good practice planning process and prepare an investigation plan. \nModule 3\nCollection and evaluation of evidence\nA role play interview is conducted with the witness and the subject\, showcasing some of the techniques essential for a good interview (introduction\, rapport building\, open-ended questions\, closed questions\, producing documents\, challenge questions etc.)\, including poor interviewing techniques to show what can happen with poor interview practices.  At the end of the session\, we will summarise the investigation. \nModule 4\nReport Writing\nWe discuss report writing\, finalise the key findings together and the structure of the report. A final example of the investigation report is reviewed. Section 748 of the Dodd-Frank Wall Street Reform and Consumer Protection Act established a whistleblower program under which the CFTC will pay awards\, based on collected monetary sanctions\, to eligible whistleblowers who voluntarily provide original information about violations of the Commodity Exchange Act that lead either to a “covered judicial or administrative action” or a “related action.” Mr. Ehrman formerly served as an Assistant Director in the Office of Market Intelligence at the Securities and Exchange Commission. When he resigned\, he copied hundreds of tax rulings that have lead\, amongst other documents\, to the so-called “LuxLeaks scandal”. The disclosure of large-scale tax avoidance practices fostered several initiatives for better tax justice. But Antoine Deltour faced criminal charges in Luxembourg. After a first conviction to a 12-months suspended sentence in 2016 followed by several appeals\, he was finally recognized a whistleblower and was acquitted for all the charges related to the Luxleaks. He is now working for the French statistics administration and is involved in several organizations protecting whistleblowers. \n  \n \n

DESCRIPTION:In this ACi webinar kindly sponsored by Scheonherr\, we explore the challenges of conducting corporate investigations in Central and Eastern Europe. \nWe will look at some of the key issues investigators face including: Remote investigations and interviews; Working across borders; Language and cultural considerations; Legal requirements; Corporate processes and procedures.  We will look at a range of issues investigators face and give some expert advice on how to keep investigations on track.\n\n\n\n\n\n\n\n\n \n\n\n\nPanel:\n\n\n\n\nGeorgiana Bădescu\nGeorgiana Bădescu is a partner at Schoenherr\, where she heads the EU & competition practice group. Her experience covers the full range of competition matters. Relevant projects include a consistent series of national and EU-level merger control cases\, advice in virtually all large-scale sector inquiries or investigations for potential breaches conducted by the national competition authority\, various competition assessments\, general competition advice to a strong portfolio of clients\, as well as state aid matters. Georgiana’s experience also includes assistance in ground-breaking projects\, such as the monitoring of commitments undertaken by entities investigated by the Romanian competition regulator. She has conducted a considerable number of compliance audits\, has implemented mock dawn raids\, and has delivered competition training programmes for the clients’ teams. Georgiana is actively involved in advocacy projects as part of her membership in the AmCham competition & state aid task force. She is frequently invited as speaker in competition events and has authored numerous articles on EU & competition legal topics. \n\n  \nChristoph Haid\nChristoph Haid is a partner at Schoenherr and joined the law firm in January 2004. He is a member of the EU & Competition department and co-heads Schoenherr’s Compliance & Investigations teams. \nOn the competition law side\, he has since been involved in numerous high-profile merger control proceedings before the Austrian competition authorities and the European Commission\, and coordinated global merger control filings\, particularly in CEE\, where his focal point of work is. On the compliance side\, Christoph is frequently involved in supporting clients to implement comprehensive compliance programmes\, investigate perceived misconduct and respond to emergency situations. \n  \n  \nElisa Castrolugo is the Head of Internal Investigations (Global) for Getinge\, a leading Swedish medical technology company\, and has held a similar position for a major multinational based in Belgium. Prior to transitioning to the private sector\, Ms. Castrolugo worked for over a decade with the U.S. Department of Justice as a federal criminal prosecutor\, immigration judge and overseas legal advisor on anti-money laundering and countering terrorist financing. Ms. Castrolugo holds a law degree from Columbia University Law School in New York City and a bachelor’s degree in History from The University of Texas at Austin. \n  \n  \nMaria Dardai\nMaria Dardai is an experienced legal professional\, with over 15 years’ experience and with a demonstrated history of working as a “real generalist” in different types of industries. She is skilled in almost all area of internal legal matters\, with specific expertise in the telecom industry and all kinds of compliance matters. A very experienced leader in the area of management\, Maria is a strong legal professional who graduated from ELTE\, Budapest\, and whose further education continued in the prestigious IMD Business School\, Lausanne\, Switzerland. \n  \n  \n  \n  \n  \nModerator: \nManu Hanspal\nManu Hanspal is currently Investigations Lead EMEA/AMA at Rio Tinto conducting and overseeing investigations into Business integrity concerns in addition to having accountability for the management and development of the Global Investigations programme. Manu additionally designs and delivers in-house investigations training for compliance\, HR\, Legal and business specialists in order to enhance this capability whilst also contributing to the development of the ACi education and training programme.  Manu’s investigative experience stems from having served within U.K. Law enforcement for 15 years leading teams investigating serious and organised crime using specialist\, proactive and covert methods. Having worked across sectors and transitioned to corporate investigations\, Manu brings a keen understanding of the operational challenges and elements required for those conducting investigations.
